Ex-Kentucky Governor Pardoned Child Rapist Because 9-Year-Old’s Hymen Was Intact


Matt Bevin's rationale for pardoning the child rapist has been shot down as a myth with no scientific support.

Former Kentucky Governor Matt Bevin pardoned a slew of criminals before leaving office this year, but the Republican’s defense of pardoning one offender in particular brought significant — and well-deserved — backlash.

According to The Washington Post, Bevin decided to pardon a man convicted of raping a 9-year-old girl because he did not believe the child was actually a victim.

“There was zero evidence,” Bevin told talk-radio host Terry Meiners of WHAS, insisting that because the girl’s hymen was intact, she could not have been raped.

Medical and forensics experts were quick to admonish the former governor, explaining that sexual abuse often does not result in physical damage to the child — least of all a broken hymen.

“Scientists have debunked the notion that inspecting an alleged victim’s hymen can prove whether they were sexually assaulted, and found that most survivors of child sexual abuse do not have any physical damage,” The Post reported.

George Nichols, a former Kentucky medical examiner who is an expert in evaluating child abuse, said Bevin “clearly doesn’t know medicine and anatomy.”

When Meiners asked Bevin how he could stomach pardoning a child rapist, The Post reported, the former governor responded: “Which one?”

The rapist in question is 41-year-old Micah Schoettle, sentenced to 23 years in prison last year after his conviction on rape, incest, sodomy and other sexual offenses.

Bevin issued Schoettle’s pardon just one day before he left office, setting the rapist free after serving just 19 months of his sentence. And thanks to the pardon, Schoettle will not have to register as a sex offender, The Post noted.

In defense of his decision, Bevin told Meiners: “Both their hymens were intact. This is perhaps more specific than people would want, but trust me, if you have been repeatedly sexually violated as a small child by an adult, there are going to be repercussions of that physically and medically.”

Bevin said Schoettle had been accused of abusing two sisters, but one denied he had harmed her.

Nichols, the medical examiner, said Bevin’s statements were false: “Rape is not proved by hymen penetration. Rape is proved by phallic penetration … where the vaginal lips meet the outer surface of the vagina."

Kenton County Commonwealth’s Attorney Rob Sanders, who prosecuted the case and was a former supporter of the governor, blasted Bevin as being “ignorant” of science.

Well deserved? One of the sisters insisted he NEVER TOUCHED THEM. It's not like their hymens were the sole evidence. You have a case where one child says none of this ever happened and so you inspect the children and both of hymens. Plus there is so much dodgy word acrobats going on here it's absurd. Yes, sexual assaults of many kinds can occur without effecting the hymen, however this man was accused of repeatedly raping both girls countless times. Vaginal penetration with a penis and likely digits. While someone can be assaulted without rupturing the hymen, the likelyhood of someone being repeatedly raped for two years without tearing the hymen are astronomically low. This is prosecution lawyers manipulating professionals to create an illusion of guilt. When doctors say one can be sexually assaulted without tearing the hymen, they are referring to types of sexual assault that do not include vaginal penetration. While it is POSSIBLE to penetrate the vagina without tearing the hymen, a grown man penetrating a 9 year olds vagina countless times over two years without tearing the hymen is simply not possible.

How many women do you know had full on vaginal intercourse for two years without popping their cherries? He was accused of specific offenses. He was specifically accused of penetrating her tiny, undeveloped, 9 year old girl vagina with his adult penis countless times.

And you've got the elder sister insisting the man is innocent and he never touched them.

Yes, it is a horrible thing for a sex abuse victim to not be believed, but this man is clearly innocent.

Anyone who can calmly and rationally observe the facts of this case can see that.

Don't be so blinded that you can't see reality in front of you. While most accusations are true, not all are. Sometimes innocent men are accused. Maybe the girl was assaulted in a different way by a different person. Who knows what happened.

But when an adult man vaginally rapes a child repeatedly for years, he's going to hurt her. Not to mention the testimony of the elder sister insisting he never touched them.


Team party politics clouds peoples judgement these days and most don't read beyond the slanted headline. I would like to see the court transcripts from this case, if there was zero evidence as Bevins says then this guy must have had the worst lawyer. Prosecutors can be dangerous especially when they are trying to climb up the ladder
